Participant Informed Consent

I, (participant), desire to engage voluntarily in an exercise training program in order to attempt to improve my Aquatic Fitness certifications. I understand that the activities are designed to place a gradually increasing workload on the cardiorespiratory and skeletal/muscle systems and thereby attempt to improve their function. The reaction of the cardiorespiratory and skeletal/muscle systems cannot be predicted with complete accuracy. These changes might include abnormalities of blood pressure and heart rate.

I understand that the purpose of the exercise program is to develop and maintain cardiovascular fitness, body composition, flexibility, muscular strength, and endurance. A specific exercise plan will be given, based on needs, interests, and doctor’s recommendations. All  exercise programs include a warm-up, exercises at training heart rate and perceived exertion, resistance training, and a cool down. All modalities of exercise may be incorporated in order to meet the needs of the client. All programs are designed to place gradually increasing workloads on the body in order to improve overall fitness. The rate of progression is regulated by exercise target heart rate and perceived effort of exercise.

I, (participant), understand that I am responsible for monitoring my own condition throughout the exercise program and should any unusual symptoms occur, I would cease my participation and inform the instructor of my symptoms. I have consulted my physician before participating in an exercise program and have his/her approval.

In signing this consent form, I affirm that I have read this form in its entirety and that I understand the nature of the exercise program. I also affirm that my questions regarding the exercise program have been answered to my satisfaction.

I, (participant), agree to hold harmless Acquapole ® , Indigo Aquatics™, the training hosting facility, its officers, directors, employees, volunteers, consultants, independent contractors and affiliates from any and all liability arising out of my participation in this event including claims that are foreseen and unforeseen, but not limited to, muscles strains, tears, pulls, broken bones, and all illnesses or loss to my person or property.

Additionally, I (participant) understand the risks involved with participating in this strenuous event and attest that I am in sound
physical condition.

I ATTEST THAT I HAVE READ THE INFORMED CONSENT FORM AND THAT I UNDERSTAND IT FULLY.

Release Form for Social Media and Personal Information

I, the undersigned, do hereby grant permission to Acquapole, its employees, affiliates, or agents the right to take photographs, videotape, or digital recordings, hereinafter referred to as “Materials” of my participation in a company sponsored event. I grant permission to post the “Materials” to the Acquapole Web site, YouTube, Twitter account (@acquapole), Facebook account, and any other social media accounts. I further consent that my name and identity may be revealed therein or by descriptive text or commentary.

I do hereby release to Acquapole, its agents, managers, officers, and employees, from all claims and demands arising out of or in connection with any use of said “Materials, including, without limitation, all claims for invasion of privacy, infringement of my right of publicity, defamation and any other personal and/or property rights. I understand that there will be no financial or other remuneration will be due to me as a result of the use of the “Materials” or any rights therein.

I further agree that, as between myself and Acquapole, Acquapole is the sole owner of the Materials, and hereby assign any and all rights I may have in the Materials to Acquapole or, if such assignment of rights is prohibited, I grant to Acquapole a royalty-free, irrevocable, perpetual license to such rights. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used, including any right to inspect or approve the finished Materials. I further waive any right to royalties or other compensation arising from or related to the use of the Materials.

I also authorize Acquapole, its employees, affiliates, or agents (including but not limited to Indigo Aquatics, Inc., a Florida corporation (“Indigo”)) to collect, store, use, process and disclose, in the course of conducting Acquapole’s business, including but not limited to listing me as a “certified instructor” on Acquapole’s and/or its affiliates/agents (including Indigo’s) website, any and all personal information provided by me (including but not limited to my name, age, address, e-mail, phone number, and job-position). The foregoing grant of authority shall specifically include, but not be limited to, granting Indigo the right to include such information in Indigo’s trainer database, and using such information in newsletters, directories listing instructors and facilities, and other similar uses. I also understand that Acquapole is not responsible for any expense or liability incurred as a result of my participation in this recording, including medical expenses due to any sickness or injury incurred as a result.

I represent that I am at least 18 years of age, have read and understand the foregoing statement, and am competent to execute this agreement.
